La concesión había sido otorgada a Garay en 1842 por el entonces presidente Antonio López de Santa Anna. Sin embargo, por faltas a las obligaciones estipuladas en el contrato y por una serie de irregularidades en la adjudicación del mismo, el gobierno mexicano decidió retirar la concesión.
